Response to a comment on HC branch in KBK?

Some people pointed that High Court Bench in Bhawanipatna instead of Sambalpur/Berhampur is motivated and it should be based on population, not by geography. We urgue them to read the article (Samaja, Aug 7, 2010) below (posting again) carefully.



(1) Lucknow High Court Bench was created based on severe work pressuer and load in Allahabad Hig Court whereas Cuttack HC does not have such problem.


(2) Shilong was created based on inaccessibility and backwardness in north eastern states where logic for KBK fits.

(3) If population is every thing, then in Odisha every thing should be located in Coastal Odisha where poulation is high, and not in Sambalpur (instead of Cuttack, Bhubaneswar, Berhampur). For western Odisha it should go to Rourkela by population. Similarly in India every thing should be located in UP, Maharastra, West Bengal, Bihar etc and not in Odisha. IIT Bhubaneswar would have been located in Nagpur instead of Bhubaneswar as Bhubaneswar is 48th city by population in India.

(4) Our beleive is things should be located based on geography (regional basis), for which a town may be chosen in a region convinient to every one based on distance. IIT, NISER etc were located in Bhubaneswar based on reginal basis (state quota). In the country still many things are located based on regional basis (state basis). In odisha also University, medical college, engg college etc were established earlier in Sambalpur and Berhampur based on regional basis (geography), so were RDCs.

(5) As the communication between Bhubaneswar and Sambalpur/Berhampur has improved, to and fro communication is possible within a day, such regional development now should concentrate in far off remote and backward region like KBK. The direct rail connectivity from Bhubaneswar-Cuttack to KBK may take at least another two decades, that too to place like Bhawanipatna, Nabarangpur and Koraput, it is in doubt.
 
(6) Our guess is Bhawanipatna could be a central town suitable for all KBK-Kandhamal districts, where direct train communication to state capital or Cuttack may not be possible in next two decades. In that respect Bhawanipatna remains inaccessible for next two decades or more along with Koraput. If Khordha-Balangir railway is made by this time, it may help for Boudh, Sonepur and Balangir to have direct link with Bhubaneswar, but not for Bhawanipatna, Koraput, Nabarangpur, Nuapada, Ryagada, Malakangiri etc.
 
(7) However, for medical college, hospital and university we continue to argue each undivided disitrict of KBK should have at least ONE. Of course, any establishement including HC bench in KBK if there is more than ONE possibility, it should be distributed among KBK districts or in undivided district level.

Dr. Patro kindly be informed that more than distance, the percentage of cases originating from a particular region is important for establishemnt of circuit benches of high court. In this respect Southern orissa accounts for more than 35% of the cases pending in Orissa High Court and Ganjam District alone close to 15%. One may say that the distance between the principal bench and Berhampur is only 200 kms, but there are instances where benches have been set up with disatnce even less than this. Though the Justice Pal Commission is looking into the merits of the issue, but it is expected to take a view only based on the suggestions of the state Govt to set up benches at Sambalpur and Berhampur as the demand from these places goes back to the 50s and 60s.

Hi,
As per cases you are right, but still I think total number of cases in Orissa HC does not necessitates another bench, one criteria that may validate for Odisha to have another bench is backwardness and inaccessibility of KBK region in the line of North Eastern states. Perhaps that is the reason why earlier Sambalpur and Berhampur proposal was rejected by the court except in political use.
