High Court Branch Issue in Orissa

Note: As per the following article the minimum distance for High Court Branch should be 300 km for which neither Berhampur nor Sambalpur fit  to have a HC branch. Poor communication and infrastructure are other requirement criteria for new High Court Branch in the line of North Eastern states, and both Sambalpur and Berhampur have better rail & road service to Cuttack. Taking distance and poor communication as main criteria for HC branch, the region which genuinely deserves a high court branch in Orissa is KBK region. If such a branch is established at Bhawanipatna, being a central location it will serve all KBK districts, Kanhamal, Boudh as well as large part of both Western and Southern Orissa. In this context a single High Court Branch at Bhawanipatna will serve the interest of South and Western Orissa as well as based on distance and poor communication.

The Jaswant Singh Commission never outlined that the distance should be 300 kms. Does the Article say that the Union Law Minister is ignorent of this clause when he declared that Sambalpur will be considered as a first choice when the division benches are established. It is an interpretation of the Cuttack based lawyers who don't want the high court to spread out. Further the distance between Cuttack and Berhampur is not 170 but 200 kms and it seems the mistake is deliberate. The criteria that sufficient number of cases should originate from the region and here south orissa is seen as a region which contributes more than 35% of the cases pending in Orissa High court. The division bench is for the region which has an average distance of more than 300 kms from cuttack, and for this the region is taken as a single entity and within the region it should be left to the people as to where they want their High court according to the existing facilities. There is a hitory and sequence of events to the demand for a highcourt bench in southern orissa and if the lawyers from Cuttack, who are always against the intersts of southern region, agree for a division bench in the southern region first, then let the 48 MLAs of Southern Orissa decide on the location, but denying south orissa a high court bench has no logic.
